Terms of Service
1. Who you are agreeing with
These Terms of Service ("Terms") are an agreement between you and Zuhayr Huseni, a sole proprietor ("Qissa", "we", "us", "our"), which runs the Qissa iPhone app ("the App").
Contact: support@learnqissa.app
By downloading or using the App, you agree to these Terms. If you do not agree, please do not use the App.
2. Who can use Qissa
Qissa is for people 13 and up. You must be at least 13 years old to use the App, and by agreeing to these Terms you confirm that you are.
If you are under 18 and live in the United States, you need a parent's or guardian's agreement to these Terms. By letting you use the App, they agree to these Terms for you and are responsible for your use of it.
3. The service
Qissa is an app for learning Urdu. It includes:
- lessons with audio, text, transliteration, and story and history cards;
- speaking practice: you speak, play yourself back, and rate yourself. If you turn on "Check my words on Qissa's server" and it is available to you, our server checks whether the words of a short line were there, then discards the recording;
- flashcard review on a spaced-repetition schedule; and
- story episodes for listening.
There is no live AI in this version of Qissa. If a future version adds an AI feature, the App will ask you first before it is used.
Some content needs an active trial or paid plan.
4. Subscriptions, trials, and billing
4.1 Plans and price
The App offers subscription plans that renew automatically, and may also offer a one-time purchase. Which plans are available, how long each one runs, and what it costs are shown on the purchase screen. You pay the price shown on the purchase screen before you confirm, through Apple, in the currency Apple shows you.
4.2 Free trials
- If the purchase screen offers a free trial, it shows the date the trial ends and the last day to cancel to pay nothing.
- A free trial turns into a paid subscription on the date shown on the purchase screen, unless you cancel at least 24 hours before the trial ends.
- You are not charged during the trial.
4.3 Automatic renewal and cancelling
- A subscription renews automatically, for the same length and at the current price, until you cancel it.
- To stop the next renewal, cancel at least 24 hours before the end of the current period. Apple may charge for the renewal in the 24 hours before the period ends.
- To cancel, open your Apple ID settings: on iPhone, Settings → your name → Subscriptions → Qissa. You can also get there from the App: Settings → "Manage subscription".
- Cancelling stops future renewals. You keep access until the end of the period you have paid for.
- Deleting the App, or deleting your Qissa account, does not cancel a subscription.
- If Apple cannot charge your payment method at renewal, your subscription may end.
4.4 Your renewal date
Your next renewal date is always shown in your Apple ID settings: on iPhone, Settings → your name → Subscriptions.
4.5 Price changes
If we change the price of a subscription, Apple tells you before the new price applies, through its own subscription emails and screens. Where Apple or the law requires your agreement to a higher price, your subscription will not renew at that price unless you agree.
If you subscribed at a founding price, you keep that price for as long as your subscription stays active. If it ends, a new subscription is at the price shown on the purchase screen then.
4.6 Refunds
Apple processes every purchase, so refunds are handled by Apple under its refund policy. To ask for one, visit reportaproblem.apple.com. Nothing in these Terms takes away a refund right you have under the law where you live.
4.7 Restoring purchases
If you bought Qissa before on the same Apple ID, use "Restore purchases" in the App to bring it back.
5. Using Qissa fairly
Use the App for your own personal, non-commercial learning, and within the law. Please do not:
- reverse-engineer, decompile, or disassemble the App;
- copy lesson content or audio out of the App in bulk;
- use bots or scrapers on the App or our server;
- try to use someone else's account; or
- try to get around payment checks or any other protection.
6. Ownership
6.1 Our content
The lessons, story cards, Urdu phrases, transliterations, notes, audio, artwork, and software in the App belong to Qissa or to people who have licensed them to us, and are protected by copyright and other laws. You may not copy, share, change, or build on them without our written permission.
6.2 Your voice
Your voice is yours. If you turn on "Check my words on Qissa's server", you let us process a take only to check the words of that line, once. We then discard it. We never store it, never use it to train any model, and never use it for anything else. Our Privacy Policy explains this in full.
6.3 Feedback
If you send us ideas or bug reports, we may use them freely, without payment or credit. We do not have to act on them.
7. Privacy
Our Privacy Policy explains what we collect and how we protect it. It forms part of these Terms.
8. Other services
The App relies on services from others, including Apple (App Store, purchases, Keychain) and the providers listed in our Privacy Policy. Their own terms apply to them, and we are not responsible for how they run.
9. No warranties
To the fullest extent the law allows:
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not promise that:
- the App will always work, or be free of errors or harmful components;
- the App will meet your needs;
- every fault will be fixed; or
- the words check will always be right. It is an automated check, and Urdu speech is hard for machines. You can always tap "I said it right".
If you live in the UK, the EU, or another place where consumer law gives you rights that a contract cannot remove, nothing in these Terms affects them.
10. Limit of liability
To the fullest extent the law allows:
WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE APP.
OUR TOTAL LIABILITY FOR ANY CLAIM ABOUT THESE TERMS OR THE APP IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR 100 US DOLLARS.
Nothing in these Terms limits liability that the law does not allow us to limit, such as for death or personal injury caused by negligence, or for fraud.
11. Indemnity
You agree to cover our reasonable costs (including legal fees) from claims that arise because you broke these Terms or the law, or infringed someone else's rights, while using the App.
12. Ending this agreement
12.1 By you
You can stop using the App at any time, and delete your account in the App. To stop paying, cancel the subscription as described in 4.3.
12.2 By us
We may suspend or end your access if you seriously or repeatedly break these Terms. Where it is reasonable, we will tell you first.
12.3 What continues afterwards
When this agreement ends, your licence to use the App ends. Sections 6.1, 9, 10, 11, 13 and 14 continue to apply.
13. Governing law and disputes
These Terms are governed by the laws of the State of California, United States. If you live in the UK or the EU, you also keep the protection of the mandatory consumer laws of where you live, and you can bring a claim in your local courts.
If something goes wrong, please write to us first at support@learnqissa.app. Most problems can be fixed quickly that way.
14. Terms Apple requires
Because the App is distributed through Apple's App Store:
- These Terms are between you and Qissa only, not Apple. Apple is not a party to them.
- Your licence is a non-transferable licence to use the App on Apple devices you own or control, as the App Store terms allow.
- Apple has no duty to provide maintenance or support for the App.
- Apple is not responsible for product liability, consumer protection, or intellectual property claims about the App. Qissa is responsible for those.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
15. Changes to these Terms
If we change these Terms in a way that matters, we will tell you in the App before the change takes effect. If you keep using the App after that date, the new Terms apply. If you do not agree, you can stop using the App and cancel your subscription.
16. The rest
- Whole agreement. These Terms and the Privacy Policy are the whole agreement between you and Qissa about the App.
- If part fails. If a court finds part of these Terms unenforceable, the rest still applies.
- No waiver. If we do not enforce a right straight away, we have not given it up.
- Transfer. You may not transfer your rights under these Terms. We may transfer ours if Qissa is sold or merged, and your rights stay the same.
